How do we get a land title transfer when one of the owners is gone? |
Question: We paid off some land from my step daughter and son in law, and they told us it was ours. Now, my son in law and her are divorced and he is gone and we don't know where he is at all. How can we get the title of the land over into our names. We have paid the taxes on it for the past 6-8 years. Answer: If the "KIDS" were divorced, there should be a property settlement available which would likely itemize the property in your step-daughter's name or her ex-husband (usually accompanied by a quit claim deed relinquishing the other person's interest in the property). If your step-daughter (or perhaps a court file) has these documents she has sole interest in the property and can easily transfer it to your name. If not you will need to call a lawyer to make a claim in absentia. |
